Key Takeaways

  • •Australian engineer Robert Pether returns to Ireland after five years in Iraq detention
  • •His detention criticized as illegal by the UN, impacting his family deeply
  • •Release achieved through extensive diplomatic efforts by Australia and Ireland
  • •International court ruled in favor of Pether's employer, CME Consulting

Robert Pether, an Australian engineer, is finally back in Ireland after being detained in an Iraqi jail. The 51-year-old was arrested in 2021, accused of fraud linked to a contract dispute between his company, CME Consulting, and the Central Bank of Iraq. The United Nations slammed his detention as illegal, and an international court ruled that Iraq's central bank was at fault in the dispute.

On Monday morning, Pether landed at Dublin Airport, where his family eagerly awaited him. He was emotional, thanking his wife and children for their unwavering support during his imprisonment. "Our children lost years with their dad, " he said, overcome with emotion. "They watched their mum fight every day to try and bring me home." He called his wife Desree "incredible" for her tireless efforts to secure his release while taking care of the family.

The release came after extensive diplomatic efforts from both Australia and Ireland. Australia's Foreign Minister, Penny Wong, emphasized the advocacy that led to this moment. "I spoke to Mr. Pether shortly before his departure from Baghdad and am pleased he is now free to move forward with his life, " she said. Desree Pether described the ordeal as a "nightmare, " especially during the final months before her husband's release, in a statement to the BBC.

Pether's legal troubles started when he and his colleague, Egyptian national Khalid Radwan, were accused by the Central Bank of Iraq of embezzling funds from a reconstruction project in Baghdad. They were held for nearly six months without charges before a hasty trial sentenced them to five years in prison and a $12 million fine.

International Legal and Diplomatic Developments

In 2022, a UN report blasted the handling of Pether's case, citing breaches of international law and "abusive and coercive" interrogation tactics. Iraq's government, however, denied any mistreatment. The International Chamber of Commerce's Court of Arbitration later ruled in favor of CME Consulting, ordering Iraq's central bank to pay the company $13 million.

Pether was conditionally released from prison last year, but that didn't mean he was free to leave Iraq immediately, as he still faced potential legal hurdles. Persistent diplomatic pressure finally led to his full release, allowing him to reunite with his family in Ireland.

The situation for Khalid Radwan remains uncertain, with no word on his release. The case has attracted international attention, shining a light on the complexities faced by foreign nationals caught in legal disputes in Iraq.
